Terms and Conditions Funkytex
Article 1 — Definitions
In these general terms and conditions, the following definitions apply: Trader: Funkytex, established in Oisterwijk, Chamber of Commerce number 18041333. Consumer: the natural person who is not acting in the course of a profession or business and enters into a distance contract with the trader.
Article 2 — Applicability
These general terms and conditions apply to every offer made by the retailer and to every distance contract and order concluded between the retailer and the consumer.
Article 3 – The offer
The offer contains a full and accurate description of the products on offer. The description is sufficiently detailed to allow the consumer to make a proper assessment of the offer. Mistakes or errors in the offer are not binding on the seller.
Artikel 4 — The price
All prices include VAT. Shipping costs are listed separately. Obvious errors in pricing, such as manifest inaccuracies, may be corrected by the trader even after the agreement has been concluded.
Article 5 — Conformity and Warranty
The seller guarantees that the products conform to the agreement, the specifications stated in the offer, reasonable requirements of soundness and/or fitness for purpose, and the statutory provisions and/or government regulations in force at the time the agreement was concluded.
Article 6 — Delivery and fulfilment
The trader shall exercise the utmost care when receiving and fulfilling product orders. The delivery address shall be the address the consumer has provided to the company. The trader will fulfil accepted orders as promptly as possible.
Article 7 — Right of Withdrawal
When purchasing products, the consumer has the right to cancel the agreement without giving any reason within 30 days. This cooling-off period begins on the day after the consumer receives the product. Products that have been cut to size cannot be returned.
Article 8 — Costs in the event of cancellation
If the consumer exercises their right of withdrawal, the costs of return shipment shall be at most for their own account. If the consumer has made a payment, the trader will refund this amount as soon as possible, and no later than 30 days after the return or withdrawal.
Article 9 — Payment
Unless otherwise stipulated in the agreement or additional terms and conditions, amounts owed by the consumer must be paid within 14 days of the start of the cooling-off period. When selling products to consumers, the general terms and conditions may never require the consumer to make an advance payment of more than 50%.
Artikel 10 – Complaints Procedure
The trader has a sufficiently publicised complaints procedure and handles complaints in accordance with this procedure. Complaints regarding the execution of the agreement must be submitted to the trader within 7 days, fully and clearly described, after the consumer has identified the defects.
Artikel 11 — Disputes
All agreements between the trader and the consumer to which these general terms and conditions apply are governed exclusively by Dutch law. This applies regardless of whether the consumer resides abroad. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
